MINUTES

 

The regular meeting of the Camden County Board of Commissioners was held Monday, April 5, 2004 at 8:00 a.m. in the Senior Center Conference Room, Courthouse Complex.  The following members were present:

 

Chairman Jeffrey B. Jennings

Vice Chairman Samuel K. Shaw

Commissioners J.C. Rountree, Melvin Jeralds, and Clayton Riggs

Clerk to the Board Ava Murgia

 

County Manager Randell Woodruff was absent due to surgery.

 

Chairman Jennings called the meeting to order and invocation was given by Vice Chairman Samuel K. Shaw.

 

Public Comments

 

Chairman Jennings called for any comments from the public.

 

Bob Albury, 105 Upton Road, stated at the last tax evaluation his fence was taxed while other properties in the county were not.  Mr. Albury quoted NC State Constitution, Article V. Finance, Section 2. State and local taxation (1) Power of tqxation.  Mr. Albury requested that the fence tax be deleted from property valuation, and/or send out staff to get all fenced property, and/or do not tax anyone until valuation of fenced property is complete.

 

Hearing no further comments from the public, Chairman Jennings proceeded with the meeting.

 

Consideration of Minutes  -  March 10, 2004 Joint Meeting with Currituck Board of Commissioners, March 15, 2004 Goal’s Setting Meeting and March  15, 2004 Regular Meeting 

 

Commissioner Riggs made a motion to approve the minutes of the March 10, 2004 Joint Meeting with the Currituck Board of Commissioners, March 15, 2004 Goal’s Setting Meeting and March  15, 2004 Regular Meeting.  The motion passed with Chairman Jennings, Commissioners Shaw, Rountree, Jeralds, and Riggs voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

 

Consideration of Agenda 

 

Chairman Jennings asked for any amendments to the agenda.

 

Chairman Jennings asked that the agenda be amended as follows: add Item VIII. M. Storage Buildings in Core Villages.

 

Commissioner Jeralds asked that the agenda be amended as follows:  add for discussion Item VIII. N. Use of Motorized Vehicles.

 

Commissioner Jeralds made a motion to approve the agenda as amended. The motion passed with Chairman Jennings, Commissioners Shaw, Rountree, Jeralds, and Riggs voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

 

Babe Ruth Association Request

 

 At the March 15, 2004 Board meeting Keith Ward of the Babe Ruth Association requested permission for the Babe Ruth Association to develop the property south of Camden Community Park for additional baseball/softball playing fields.

 

Commissioner Riggs made a motion to approve Mr. Ward’s request to develop the property south of Camden Community Park for additional baseball/softball playing fields.  The motion passed with Chairman Jennings, Commissioners Shaw, Rountree, Jeralds, and Riggs voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

 

Surplus Sale Items 

 

Staff submitted a list of surplus items for the auction scheduled on April 24, 2004 and the commission rates of Auctioneer Bill Forbes for approval.

 

The motion passed with Chairman Jennings, Commissioners Shaw, Rountree, Jeralds, and Riggs voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

 

Scrap Tire Recycling & Disposal Contract – Central Carolina Holdings  

 

In October 2003 staff received a scrap tire recycling and disposal contract from Central Carolina Holdings, LLC stating Central Carolina is in the process of applying for industrial revenue bonds to finance capital investment in equipment to increase their capability to recycle scrap tires. 

 

Under advisement from their bank, Central Carolina is seeking contracts with the counties they are presently doing business with.

 

Central Carolina proposes to contract with the county for five (5) years at the same price for the (5) year contract. 

 

Bill Meiggs, Maintenance Superintendent, has had no problems with them in the past.

 

At the October 20, 2003 Commissioners meeting, the Board requested the contract be sent to the attorney for review.  Mr. Mullen has reviewed the contract and no changes were recommended.

 

Following discussion, and hearing no objection, Chairman Jennings requested that staff contact Tim McNeil of Central Carolina Holdings to appear before the Board to answer questions and discuss issues regarding the proposed scrap tire contract.

 

Ordinance No. 2004-04-01 – A Proposed Ordinance Amending An Ordinance of the Camden County Board of Commissioners Defining and Prohibiting Nuisances Within Camden County  

 

Commissioner Riggs made a motion to introduce Ordinance No. 2004-04-01 and set for public hearing on April 19, 2004 at 7:00 p.m. or as soon thereafter as the agenda allows. The motion passed with Chairman Jennings, Commissioners Shaw, Rountree, Jeralds, and Riggs voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

 

Resolution No. 2004-04-01 Relating to Addition to State Maintained Secondary Road System – Long Pine Road – Sanders Crossing Subdivision – South Mills Township     

 

Commissioner Rountree made a motion to approve Resolution No. 2004-04-01 requesting NCDOT add Long Pine Road, Sanders Crossing Subdivision, South Mills Township, to the state maintained secondary road system and direct staff to send to NCDOT for processing.  The motion passed with Chairman Jennings, Commissioners Shaw, Rountree, Jeralds, and Riggs voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

NORTH CAROLINA STATE DEPARTMENT OF TRANSPORTATION REQUEST FOR ADDITION TO STATE MAINTAINED SECONDARY ROAD SYSTEM

 

North Carolina

County of Camden

Road Description:               Long Pine Road, Sanders Crossing Subdivision, South Mills Township

 

------------------------------------------------------------------------------------------------------------

 

WHEREAS, the attached petition has been filed with the Board of County Commissioners of the County of Camden requesting that the above described road, the location of which has been indicated in red on the attached map, be added to the Secondary Road system; and

 

WHEREAS, the Board of County Commissioners is of the opinion that the above described road should be added to the Secondary Road System, if the road meets minimum standards and criteria established by the Division of Highways of the Department of Transportation for the addition of roads to the System.

 

NOW, THEREFORE, be it resolved by the Board of County Commissioners of the County of Camden that the Division of Highways is hereby requested to review the above described road, and to take over the road for maintenance if it meets established standards and criteria.

Proclamation for Fair Housing Month        

 

Commissioner Jeralds made a motion to approve a proclamation for April 2004 as Fair Housing Month.  The motion passed with Chairman Jennings, Commissioners Shaw, Rountree, Jeralds, and Riggs voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

 

Maria Garcia and Carolyn Anderson were present to answer any questions and Ms. Garcia invited the Board to a Housing Forum on Fair Housing at the K.E. White Center.

 

The Proclamation for Fair Housing Month April 2004 reads as follows:

 

PROCLAMATION

FOR

FAIR HOUSING MONTH

APRIL 2004

 

 

   WHEREAS, April 2004 marks the 36th anniversary of the Federal Housing Act of 1968 and the 21st anniversary of the North Carolina Fair Housing Act. Both laws prohibit discrimination in housing because of race, color, sex, religion, national origin, handicap and familial status; and

 

   WHEREAS, the Elizabeth City-Pasquotank County Community Relations Commission, Northeastern Community Development Corporation, Elizabeth City State University Community Development Program and the Albemarle Area Board of Realtors, county and local governments, concerned citizens and the housing industry, are working to make fair housing opportunities possible for all our citizens. Through their efforts, they are encouraging others to abide by the letter and the spirit of the fair housing laws; and

 

   WHEREAS, one of the most important concerns of Camden County citizens is the availability of housing to them as individuals and families. By supporting and promoting fair housing and equal opportunity, we are contributing to the health of our County and our State;

 

   NOW, THEREFORE, LET IT BE RESOLVED THAT, the Camden County Board of Commissioners, do hereby proclaim April 2004 as “Fair Housing Month” in Camden County, and urge our citizens to rededicate themselves to ensuring that fair housing laws are always upheld and citizens are protected against discrimination.

Sheriff’s Office – Resolution No. 2004-04-02 Local Government Resolution Form GHSP-06-A North Carolina Governor’s Highway Safety Program Grant Traffic Safety Reflective Vests 

 

Sheriff Perry stated a majority of Camden Sheriff Deputies are without traffic safety reflective vests. This poses a hazard to the safety of deputies directing traffic especially at night. These vests will make them more visible thereby reducing possible injury or death. The Sheriff’s Office is applying for a grant to obtain money to pay for this. This is a 75% Federal match and 25% local match.

 

The Sheriff’s Office is requesting permission to apply for the grant. The 25% local match of $250.00 will come from 2004 Sheriff Calendar Proceeds.

 

Sheriff Perry also submitted Form GSHP-06A Local Government Resolution for approval and signature.

 

Commissioner Rountree made a motion to approve the Sheriff’s Office application for the North Carolina Governor’s Highway Safety Program Grant Traffic Safety Reflective Vests with a 25% local match of $250.00 and Resolution No. 2004-04-02.  The motion passed with Chairman Jennings, Commissioners Shaw, Rountree, Jeralds, and Riggs voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

North Carolina Governor’s Highway Safety Program

LOCAL GOVERNMENTAL RESOLUTION

(To be completed, attached to and become part of Form GHSP-06, Highway Safety Equipment Project Contract.)

 

WHEREAS, the Camden County Sheriff’s Office (herein called the “Agency") has completed an application contract entitled  Traffic Vest (ANSI) Compliance Purchase and that Camden County Board of Commissioners (herein called the "Governing Body”) has thoroughly considered the problem identified and has reviewed the project as described in the contract;

 

 

THEREFORE, NOW BE IT RESOLVED BY THE Camden County Board of Commissioners IN OPEN MEETING ASSEMBLED IN THE CITY/County  OF Camden, NORTH CAROLINA

THIS 5th DAY OF April , 20 04 , AS FOLLOWS:

 

1.         That the project referenced above is in the best interest of the Governing Body and the general public; and

 

2.     That Major Jon Worthington be authorized to file, on behalf of the Governing Body, an application contract in the form prescribed by the Governor’s Highway Safety Program for federal funding in the amount of  $750.00 to be made to the Governing Body to assist in defraying the cost of the project described in the contract application; and

 

3.     That the Governing Body has formally appropriated the cash contribution of  $250.00

       as required by the project contract; and

 

4.         That the Project Director designated in the application contract shall furnish or make arrangement for other appropriate persons to furnish such information, data, documents and reports as required by the contract, if approved, or as may be required by the Governor's Highway Safety Program; and

 

5.     That certified copies of this resolution be included as part of the contract referenced above; and

 

6.     That this resolution shall take effect immediately upon its adoption.

Sheriff’s Office – Proclamation for National Night Out August 3, 2004 

 

The National Association of Town Watch is sponsoring a nationwide crime, drug and violence program on August 3, 2004. The Camden County Sheriff’s Office is joining forces with thousands of other communities from all across the nation in promoting cooperative, police-community crime prevention efforts.

 

This program will be set up at the South Camden Fire Station from 6 PM – 9 PM with celebrity guest, food (hotdogs) and “giveaways” will be offered to the public.  Approximately 400 people attended last year.

 

Sheriff Perry is asking that the attached proclamation be approved by the County Commissioners.

                WHEREAS, the Camden County Sheriff’s Office plays a vital role in assisting through joint crime, drug and violence prevention efforts in Camden County and is supporting “National Night Out 2004” locally; and

 

                WHEREAS, it is essential that all citizens of Camden County be aware of the importance of crime prevention programs and impact that their participation can have on reducing crime, drugs and violence in Camden County; and
