MINUTES

The regular meeting of the Camden County Board of Commissioners was held Monday, March 6, 2006 at 7:00 p.m. in the upstairs courtroom, Courthouse Complex, Camden N.C. The following members were present:

Chairman Melvin J. Jeralds
Vice Chairman Clayton D. Riggs
Commissioners Jeffrey B. Jennings, and Mike Andrews

Commissioner Carolyn Riggs was excused to attend the NACCo Conference in Washington, DC.

Also attending was County Manager Randell Woodruff, Clerk to the Board Ava Murgia, County Attorney John S. Morrison, and various staff members.

Chairman Melvin Jeralds called the meeting to order. Commissioner Jeffrey Jennings gave invocation and led the Pledge of Allegiance.

Public Comments

Chairman Melvin Jeralds called for any comments from the public.

Hearing no comments, Chairman Melvin Jeralds proceeded with the meeting.

Consideration of Minutes

Commissioner Clayton Riggs made a motion to approve the minutes of the February 20, 2006 regular meeting subject to correction of typographical and technical errors. The motion passed with Commissioners Jeffrey Jennings, Clayton Riggs, Mike Andrews and Chairman Jeralds voting aye; no Commissioner voting no; Commissioner Carolyn Riggs absent; and no Commissioner not voting.

Consideration of Agenda

Commissioner Jeffrey Jennings asked that Item IX. New Business, 11. Aaron Pippen – Tax Matter be added to the agenda.

County Manager Randell Woodruff requested that Item XVII. Closed Session, 1. Property Acquisition be deleted from the agenda.

Commissioner Mike Andrews made a motion to approve the agenda as amended. The motion passed with Commissioners Jeffrey Jennings, Clayton Riggs, Mike Andrews and Chairman Jeralds voting aye; no Commissioner voting no; Commissioner Carolyn Riggs absent; and no Commissioner not voting.

Ordinance No. 2005-12-01 – Rezoning Application (UDO 2005-11-12) Grant Banks

Following discussion Commissioner Mike Andrews made a motion to approve Ordinance No. 2005-12-01 for the rezoning of fifty two (52) acres located at the intersection of Herman Arnold Road and Bourbon Street. The motion failed with Commissioners Jeffrey Jennings, Clayton Riggs, and Chairman Jeralds voting no; Commissioner Mike Andrews voting aye; Commissioner Carolyn Riggs absent,; and no Commissioner not voting.

Ordinance No. 2006-02-01 – Rezoning Application (UDO 2005-11-42) Ricky Edwards & Garry Meiggs

Following discussion Commissioner Clayton Riggs made a motion to approve Ordinance No. 2006-02-01. The motion passed with Commissioners Jeffrey Jennings, Clayton Riggs, Mike Andrews and Chairman Jeralds voting aye; no Commissioner voting no; Commissioner Carolyn Riggs absent; and no Commissioner not voting.

Access Grant Property Lease

On February 20, 2006 the Board of Commissioners approved submittal of a CAMA Access Grant to improve the Crooked Creek access point to the North River. At that time staff did not know how much the property owner wanted to lease the adjacent property to construct the parking improvements. Per the Commissioners direction, staff offered the property owner $100.00 per year for the 6/10 acre site, with a twenty five (25) year term. The property owner has stated he will not accept less that $700.00 per year.

The grant will pay the first year lease, with the County covering the remaining twenty four (24) years.

Commissioner Clayton Riggs made a motion to reject the property owner’s offer of $700.00 per year for the property adjacent to Crooked Creek. The motion passed with Commissioners Jeffrey Jennings, Clayton Riggs, Mike Andrews and Chairman Jeralds voting aye; no Commissioner voting no; Commissioner Carolyn Riggs absent; and no Commissioner not voting.

Finance Office – Distribution Data Verification for Beer & Wine Excise Tax

Commissioner Jeffrey Jennings made a motion to authorize the Chairman to sign the Distribution Data Verification for Beer, Unfortified Wine, and Fortified Wine Excise Tax. The motion passed with Commissioners Jeffrey Jennings, Clayton Riggs, Mike Andrews and Chairman Jeralds voting aye; no Commissioner voting no; Commissioner Carolyn Riggs absent; and no Commissioner not voting.

Finance Office – Budget Amendments 2005-06-BA018 through 2005-06-BA024

Commissioner Jeffrey Jennings made a motion to approve budget amendments 2005-06-BA018, BA019, BA020, BA021, BA022, BA023, and BA-024 as submitted by the Finance Officer. The motion passed with Commissioners Jeffrey Jennings, Clayton Riggs, Mike Andrews and Chairman Jeralds voting aye; no Commissioner voting no; Commissioner Carolyn Riggs absent; and no Commissioner not voting.

Albemarle Mental Health - Second Quarterly Fiscal Monitoring Report

Commissioner Clayton Riggs made a motion to accept the Albemarle Mental Health Second Quarterly Fiscal Monitoring Report into the minutes as submitted. Aaron Pippen – Tax Matters

Commissioner Jeffrey Jennings submitted paperwork he received from Aaron Pippen regarding his boat tax value for the Tax Administrator to investigate and report the findings to the Board.

County Manager’s Report

Discussion of Extension of Subdivision Moratorium

County Manager Randell Woodruff reviewed steps that the county has taken since November 2003 to improve the county’s ability to deal with growth related issues.

Attorney Morrison stated that since the past subdivision moratoriums, the legislature has adopted a statute that has preempted common law regarding subdivision moratoriums. Mr. Morrison explained that before the Board can establish a subdivision moratorium, the Board must make a finding of the following: 1. the moratorium must have a clear statement of the problems or conditions necessitating the moratorium and what courses of action to be considered; 2. must be a clear statement of the development subject to the moratorium; 3. must have an expressed date of termination of the subdivision moratorium; and 4. clear statement of the actions and the schedule for those actions proposed to be taken by the county.

Hearing no objections, Chairman Jeralds so ordered County Attorney John S. Morrison to amend the present Ordinance to comply with the recent legislative statute for review by the Board in the event that the present subdivision moratorium could possibly be extended.

Final Unification Meeting in High School Cafeteria –April 12, 2006–7:00 p.m.

County Manager Randell Woodruff reminded the Board of the schedule countywide Unification Meeting to be held in the Camden County High School Cafeteria on April 12, 2006 at 7:00 p.m.

Work Session – Proposed Amendment to Article 151 – Ordinance No. 2006-01-02 – Monday, March 27, 2006 at 7:00 p.m.

Hearing no objections, Chairman Jeralds set a work session on the proposed amendments to Article 151 – Ordinance No. 2006-01-02 on Monday, March 27, 2006 at 7:00 p.m.

County Manager Randell Woodruff extended an invitation to the Board to the annual regional NCDOT meeting to be held Wednesday, March 29, 2006 in the upstairs courtroom in Camden.

Legislative Trip to Washington, DC

The annual legislative trip to Washington, DC has been scheduled for March 14, 15 and 16.

Closed Session

Commissioner Jeffrey Jennings made a motion to go into closed session pursuant to G.S. 143-318.11(a)(2) to consult with the attorney regarding the suit brought by the City of Chesapeake, the Lewis Family Ltd. Partnership, Camden County Action League, William Bland and wife Tracy Bland, Mike Elliot and wife Mary Lu Elliot, Lokie Flythe Jr. and wife Dawn Flythe, Marvin Myers, Robert E. Nobles, David Kravhak, and Richard Light Jr. against Camden County, the Camden County Board of Commissioner individually, and the County Manager. The motion passed with Commissioners Jeffrey Jennings, Clayton Riggs, Mike Andrews and Chairman Jeralds voting aye; no Commissioner voting no; Commissioner Carolyn Riggs absent; and no Commissioner not voting.

The Commissioner entered closed session at 8:09 p.m.

Commissioner Jeffrey Jennings made a motion to come out of closed session and back into regular session. The motion passed with Commissioners Jeffrey Jennings, Clayton Riggs, Mike Andrews and Chairman Jeralds voting aye; no Commissioner voting no; Commissioner Carolyn Riggs absent; and no Commissioner not voting.

The Commissioners re-entered regular session at 8:43 p.m.

Commissioner Jeralds called for any motions.

Hearing no motions, Chairman Jeralds proceeded with the meeting.

Adjournment

Commissioner Jeffrey Jennings made a motion to adjourn the meeting. The motion passed with Commissioners Jeffrey Jennings, Clayton Riggs, Mike Andrews and Chairman Jeralds voting aye; no Commissioner voting no; Commissioner Carolyn Riggs absent; and no Commissioner not voting.

The meeting adjourned at 8:44 p.m.
