MINUTES
The regular meeting of the Camden County Board of Commissioners
was held Tuesday, July 5, 2005 at 7:00 p.m. in the Camden County
Courthouse, Courthouse Complex, Camden, North Carolina. The
following members were present:
Chairman Melvin J. Jeralds
Commissioners Jeffrey B. Jennings, Carolyn Riggs, and Mike
Andrews
County Manager Randell Woodruff
Clerk to the Board Ava Murgia
Vice Chairman Clayton D. Riggs was absent due to traveling
constraints.
Also attending was County Attorney Herbert Mullen.
Chairman Jeralds called the meeting to order, Commissioner
Carolyn Riggs gave the invocation and led the Pledge of Allegiance.
Public Comments
Chairman Jeralds called for comments from the public.
Hearing no comments, Chairman Jeralds proceeded with the meeting.

Commissioner Carolyn
Riggs made a motion to approve the minutes of the June 6,
2005 – Pearson Appraisal Public Input
Meeting, June 6, 2005 Regular Meeting, June 7, 2005 Budget
Workshop, June 9, 2005 Budget Workshop, June 13, 2005 Budget
Workshop, and June 13, 2005 Budget Hearing subject to correction
of typographical and technical errors. The motion passed with
Commissioners Jennings, Carolyn Riggs, Andrews and Chairman
Jeralds voting aye, no Commissioner voting no; Commissioner
Clayton Riggs absent; and no Commissioner not voting.
Consideration of Agenda
Chairman Jeralds
deleted Item F. Letter of Support – Senate
Bill 568 – Certify On-Site Wastewater Contractors from
the South Camden Water and Sewer District agenda and moved
this item to IX. New Business, Item H. on the Board of Commissioners
agenda. Chairman Jeralds added IX. New Business,
Item I. Resolution No. 2005-07-01 A Resolution of Thanks to
the Mayor and City
Council of Elizabeth City, NC.
Commissioner Jennings made a motion to approve the agenda
as amended. The motion passed with Commissioners Jennings,
Carolyn Riggs, Andrews and Chairman Jeralds voting aye, no
Commissioner voting no; Commissioner Clayton Riggs absent;
and no Commissioner not voting.
Consideration of Ordinance No. 2005-06-02 - Rezoning Application
UDO 2005-04-01 Quality Crab Co. Inc.
The Planning Board met on May 18, 2005 and voted 5-0 to recommend
approval for this application to rezone from Mixed Single Family
Residential (R2)/Commercial Fishing Overlay District to Marine
Commercial (MC) with conditions as recommended by the Planning
Board.
This ordinance was introduced, set for public hearing at the
June 6, 2005 Commissioner meeting and advertised in the Daily
Advance.
Public Hearing was held on June 6, 2005 and comments were
received from the public. This matter was laid over for further
consideration.
Commissioner Jennings made a motion to approve Ordinance No.
2005-06-02 with conditions as recommended by the Planning Board.
The motion passed with Commissioners Jennings, Carolyn Riggs,
Andrews and Chairman Jeralds voting aye, no Commissioner voting
no; Commissioner Clayton Riggs absent; and no Commissioner
not voting.
Proclamation - August
2nd – National Night Out – 2005
Sheriff Tony Perry
invited the Board of Commissioners to Camden County’s 3rd Annual and the Nation’s 22nd Annual
National Night Out at the South Camden Fire Station #12 on
Sawyer’s Creek Road on Tuesday, August 2nd, 2005 from
6:00 p.m. until 9:00 p.m.
Commissioner Andrews made a motion to approve the Proclamation
for August 2nd as National Night Out 2005. The motion passed
with Commissioners Jennings, Carolyn Riggs, Andrews and Chairman
Jeralds voting aye, no Commissioner voting no; Commissioner
Clayton Riggs absent; and no Commissioner not voting.

National Night Out 2005
WHEREAS, the National
Association of Town Watch (NATW) is sponsoring a unique,
nationwide crime, drug and violence prevention
program on August 2, 2005 entitled “National Night Out”;
and
WHEREAS, the “22nd Annual National Night Out” provides
a unique opportunity for Camden County to join forces with
thousands of other communities across the country in promoting
cooperative, police-community crime prevention efforts; and
WHEREAS, the Camden
County Sheriff’s Office plays a
vital role in assisting through joint crime, drug and violence
prevention efforts in Camden County and is supporting “National
Night Out 2005” locally; and
WHEREAS, it is essential that all citizens of Camden County
be aware of the importance of crime prevention programs and
impact that their participation can have on reducing crime,
drugs and violence in Camden County; and
WHEREAS, police-community
partnerships, neighborhood safety, awareness and cooperation
are important themes of the “National
Night Out’ program;
NOW,
THEREFORE THE CAMDEN COUNTY COMMISSIONERS, do hereby call upon all
your citizens of Camden County to join the Camden
County Sheriff’s Office and the National Association
of Town Watch in supporting “22nd Annual National Night
Out” on August 2, 2005.
FURTHER,
LET IT BE RESOLVED THAT, THE CAMDEN COUNTY COMMISSIONERS,
do hereby
proclaim Tuesday, August 2, 2005 as “NATIONAL
NIGHT OUT” in Camden County.

Commissioner Jennings made a motion to approve the tax pick

Public Hearing – Rezoning Application – UDO
2005-04-40 - William J. Davenport
A Rezoning Application (UDO 2005-04-40) was received from
William J. Davenport to rezone property from Light Industrial
(I-1) and Residential (R-3-2) (two (2) acre lots) to Residential
(R-3-1) (one (1) acre lots) located on Ponderosa Drive and
Heritage Drive, South Mills Township.
The Planning Board met on June 15, 2005 and recommended denial
with a 3-2 vote.
Commissioner Jennings
made a motion to introduce Ordinance No. 2005-07-01 and set
UDO 2005-04-40 rezoning application
for public hearing on Monday, July 18, 2005 at 7:00 p.m. or
as soon thereafter as the agenda allows. The motion passed
with Commissioners Jennings, Carolyn Riggs, Andrews and Chairman
Jeralds voting aye, no Commissioner voting no; Commissioner
Clayton Riggs absent; and no Commissioner not voting.

A Rezoning Application (UDO 2005-05-05) was received from
Robert Harris to rezone property from Light Industrial (I-1)
to Highway Commercial located at 111 Lambs Road, Courthouse
Township.
The Planning Board met on June 15, 2005 and recommended approval
with a 6-0 vote.
Commissioner Jennings made a motion to introduce Ordinance
No. 2005-07-02 and set UDO 2005-05-05 rezoning application
for public hearing on Monday, July 18, 2005 at 7:00 p.m. or
as soon thereafter as the agenda allows. The motion passed
with Commissioners Jennings, Carolyn Riggs, Andrews and Chairman
Jeralds voting aye, no Commissioner voting no; Commissioner
Clayton Riggs absent; and no Commissioner not voting.
Set Public Hearing – Special Use Permit – UDO
2005-05-06 - Robert Harris Business – Harris Underground
Utilities
A Special Use Permit Application (UDO 2005-05-06) was received
from Robert Harris to conduct a business located at 111 Lambs
Road, Courthouse Township.
The Planning Board met on June 15, 2005 and recommended approval
with a 6-0 vote.
Commissioner Jennings made a motion to set UDO 2005-05-06
for public hearing on Monday, July 18, 2005 at 7:00 p.m. or
as soon thereafter as the agenda allows. The motion passed
with Commissioners Jennings, Carolyn Riggs, Andrews and Chairman
Jeralds voting aye, no Commissioner voting no; Commissioner
Clayton Riggs absent; and no Commissioner not voting.
Set Public Hearing – USDA Rural Development – Possible
Commitment of Funds for Camden Intermediate School
As part of the financing process with USDA, a public hearing
with Garland Burnette and Susan Christensen must be held with
the Board regarding the commitment of funds.
Commissioner Jennings made a motion to set public hearing
with USDA Rural Development for Monday, July 18, 2005 at 7:00
p.m. or as soon thereafter as the agenda allows. The motion
passed with Commissioners Jennings, Carolyn Riggs, Andrews
and Chairman Jeralds voting aye, no Commissioner voting no;
Commissioner Clayton Riggs absent; and no Commissioner not
voting.
Albemarle Economic
Development Commission (AEDC) – Bylaws
Following review and suggested changes to the AEDC Bylaws
by Attorney Mullen, and hearing no objections, Chairman Jeralds
so ordered County Manager Randell Woodruff to review the suggested
changes with the people who drafted the bylaws.
Letter of Support – Senate Bill 568 – Certify
On-Site Wastewater Contractors
Commissioner Carolyn Riggs made a motion to send a letter
of support requested by the Albemarle Regional Health Services
to Sen. Marc Basnight for legislation to provide a consistent
requirement for basic knowledge and ethics in the onsite wastewater
industry that is currently missing. The motion passed with
Commissioners Jennings, Carolyn Riggs, Andrews and Chairman
Jeralds voting aye, no Commissioner voting no; Commissioner
Clayton Riggs absent; and no Commissioner not voting.

Commissioner Andrews made a motion to approve Resolution No.
2005-07-01. The motion passed with Commissioners Jennings,
Carolyn Riggs, Andrews and Chairman Jeralds voting aye, no
Commissioner voting no; Commissioner Clayton Riggs absent;
and no Commissioner not voting.

A RESOLUTION OF THE CAMDEN COUNTY BOARD OF COMMISSIONERS
OF THANKS TO THE MAYOR AND CITY COUNCIL OF ELIZABETH CITY
NORTH CAROLINA
WHEREAS, Camden County is seeking a unified form of government
to enhance the revenues received from third parties to better
serve Camden County citizens;
NOW THEREFORE BE IT RESOLVED, that the Camden County Board
of Commissioners do unanimously compliment and thank the
Mayor and City Council of the City of Elizabeth City for
their support of Camden County in its effort to give the
voters of Camden County the opportunity to select for Camden
County a unified form of government.
Approved by the Camden County Board of Commissioners this
5th day of July, 2005.

South
Camden Water and Sewer District Board of Directors
Chairman
Jeralds recessed the Board of Commissioners meeting and called
the South Camden Water and Sewer District Board
of Directors meeting to order at 7:29 p.m.
Upon adjournment of the South Camden Water and Sewer District
Board of Directors meeting by Member Andrews at 7:38 p.m.,
Chairman Jeralds reconvened the regular Board of Commissioners
meeting.
Closed Session
Commissioner Jennings made a motion to go into closed session
pursuant to G.S. 143-318.11(a)(3) for the purpose of consultation
with the County Attorney. The motion passed with Commissioners
Jennings, Carolyn Riggs, Andrews and Chairman Jeralds voting
aye, no Commissioner voting no; Commissioner Clayton Riggs
absent; and no Commissioner not voting.
The Commissioners entered closed session at 7:39 p.m.
Commissioner Jennings made a motion to come out of closed
session and back into regular session. The motion passed with
Commissioners Jennings, Carolyn Riggs, Andrews and Chairman
Jeralds voting aye, no Commissioner voting no; Commissioner
Clayton Riggs absent; and no Commissioner not voting.
The Commissioners re-entered regular session at 8:04 p.m.
Upon re-entering regular session, Chairman Jeralds called
for any motions.
Hearing no motions, Chairman Jeralds proceeded with the meeting.
County Manager’s Report - NCACC – Contribution
Commissioner Carolyn Riggs made a motion to approve a one
(1) time contribution of $100.00 to the Aycock Scholarship
in honor of retired NCACC Executive Director Ronald Aycock
for the public administration program at the UNC School of
Government. The motion passed with Commissioners Jennings,
Carolyn Riggs, Andrews and Chairman Jeralds voting aye, no
Commissioner voting no; Commissioner Clayton Riggs absent;
and no Commissioner not voting.
Other Matters
Commissioner Carolyn Riggs, in light of the recent Supreme
Court decision, requested a resolution of the Board regarding
imminent domain procedures be sent to representatives in Raleigh.
Hearing no objections, Chairman Jeralds so ordered the County
Manager and County Attorney to draft a Resolution for the Board
to review.
Adjourn
There being no further business to come before the Commissioners,
Commissioner Jennings made a motion to adjourn the meeting.
The motion passed with Commissioners Jennings, Carolyn Riggs,
Andrews and Chairman Jeralds voting aye, no Commissioner voting
no; Commissioner Clayton Riggs absent; and no Commissioner
not voting.
The meeting adjourned at 9:12 p.m.
