The regular meeting of the Camden County Board of Commissioners was held Monday, February 21, 2005 at 7:00 p.m. in the Camden County Courthouse, Courthouse Complex. The following members were present:

Also attending was Attorney Herbert Mullen, Finance Officer Clarann Mansfield, and Planning Director Dan Porter.

Chairman Jeralds called the regular meeting to order. Commissioner Jennings gave the invocation and led the Pledge of Allegiance.

Public Comments

Chairman Jeralds called for any comments from the public.

Sharon Felton, 135 Marlas Way, asked for help in establishing an ordinance for animals requiring the owners to provide water, food, and shelter. Ms. Felton stated that accordingly to Animal Control there are no laws in Camden County other than public nuisance, vicious or dangerous animals, and rabies vaccines; there is nothing in the ordinance for water, food or proper shelter. Ms. Felton stated neighborhoods are growing, and people are leaving their animals out for days at the time without any supervision whatsoever. After calling Animal Control several times, she was told there was nothing Animal Control could do because Camden did not have any laws. Ms. Felton submitted the Pasquotank County Animal Ordinance for record.

Chairman Jeralds stated the Board would take her comments under advisement.

David Burgess Sr., 126 Run Swamp Road, South Mills, applauded the Camden County Board of Commissioners and Camden Board of Education for staying the course to secure funds for Camden County’s children.

Consideration of Minutes – January 17, 2005 Special Meeting and February 7, 2005 Regular Meeting

Commissioner Andrews cited a typo on page 002 of the January 17, 2005 draft minutes.

The Clerk noted the correction.

Commissioner Carolyn Riggs requested a clarification on page 004, thirteenth (13) paragraph of the January 17, 2005 draft minutes to add that the Black Bear Disposal deed was not recorded by the Register of Deeds on Sunday, but that the Register of Deeds was only in the office on Sunday to check when the deed was recorded.

The Clerk noted the correction.

Chairman Jeralds called for any other corrections to the minutes.

Hearing no further corrections, Commissioner Clayton Riggs made a motion to approve the minutes of the January 17, 2005 Special Meeting and February 7, 2005 Regular Meeting, subject to correction of typographical and technical errors. Consideration of the Agenda

County Manager Randell Woodruff asked that Item X. County Manager’s Report, E. NCDOT Meeting Update and Item X. County Manager’s Report F. QZAB Funding be added to the agenda.

Commissioner Jennings made a motion to approve the agenda as amended. The motion passed with Chairman Jeralds, Commissioners Jennings, Carolyn Riggs, Clayton Riggs, and Andrews voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Public Hearing - Scattered Site Housing (SSH) Program 2005-2008 Reset 2nd Public Hearing

This matter was set for public hearing at the December 6, 2004 Board meeting, and advertised in the Daily Advance for two (2) hearings on January 3 and February 7, 2005.

The first Public Hearing was held January 3, 2005, and no comments were received from the public.

The second public hearing was delayed until February 21, 2005 because the Board was required to adopt Resolution No. 2005-02-02 at the February 7, 2005 meeting that authorized the Camden County Board of Commissioners to serve as the SSH Selection Committee to work with staff and the consultant to select recipients, and implement the program.

Planning Director Dan Porter introduced J. Reed Whitesell, AICP, Senior Vice President of Holland Consultant, who gave an overview of the application process. Mr. Whitesell stated that out of eighteen (18) full applications that were mailed out, twelve (12) applications were returned, and two (2) did not meet the eligibility requirements. The building inspector has inspected the ten (10) houses being considered for assistance. Mr.Whitesell stated he will then review which of the six (6) applicants have the highest rating points according to the criteria and perform three (3) rehabilitations and (3) replacements. Mr. Whitesell stated a final list for the Board’s approval will be presented in May-June, 2005.

Commissioner Clayton Riggs stated he wanted to make sure that the citizens had an opportunity to submit an application since the first public hearing in January to date.

Buddy Tucker, 916 Trotman Road, asked what the income cap is.

Mr. Whitesell stated it is 50% of the county’s median income per household. An example is a family of four (4) would be a $19,000.00 cap.

John Thompson stated that if there was a requirement regarding how much property a recipient owns.

Mr. Whitesell stated the state does not have any requirements regarding net worth; it is an income based program.

Mr. Thompson stated that if a person owns more than one (1) lot, one-half (1/2) acre, that should be taken into consideration, and at that point they should sell off some property. Mr. Thompson stated they do not need a new home.

Mr. Whitesell stated that Mr. Thompson’s concerns were duly noted, and will be addressed.

Public Hearing - Special Use Permit – Belvin H. Bangle III Home Based Business – UDO 2004-11-24

Commissioner Andrews made a motion to go into public hearing to receive comments from the public regarding Special Use Permit – Belvin H. Bangle III Home Based Business – UDO 2004-11-24. The motion passed with Chairman Jeralds, Commissioners Jennings, Carolyn Riggs, Clayton Riggs, and Andrews voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Dave Parks stated the Planning Board met on December 16, 2004 and recommended approval with a 7-0 vote with conditions and modifications.

Mr. Bangle’s home based business is to roast and distribute coffee beans. It will be a self contained facility, and not a retail store.

The public hearing was set at the January 3, 2005 Board meeting, and advertised in the Daily Advance.

Applicant Belvin H. Bangle III, 116 Pine Ridge Drive, was present to answer questions.

John Thompson, 132 Country Meadows Drive, stated he had no idea what business Dave Parks was talking about, that it was approved by the Planning Board, and asked if there was any way he could get a copy of the pamphlet that the Board was looking at.

The Clerk stated to the Chairman that there is a board packet in the front reception area of the administrative offices for public viewing before each regular board meeting.

Mr. Thompson questioned what the home based business was.

Mr. Bangle stated roasted coffee beans.

Commissioner Clayton Riggs asked Mr. Bangle how large is the operation of the roasting company.

Mr. Bangle stated there is an area 10’ x 12’ on the back of his house; a very small operation of only one (1) roasting machine. Mr. Bangle stated there will be no retail business.

Commissioner Carolyn Riggs asked Dave Parks if the neighbors have been notified.

Mr. Parks stated yes.

Commissioner Andrews asked Mr. Bangle how he would get his supplies.

Mr. Bangle stated UPS, Fedex, and regular mail service.

Public Hearing – Ordinance No. 2005-02-01 an Ordinance Regarding Criminal History and Motor Vehicle Record Checks

County Manager Randell Woodruff stated this is a new ordinance that would give the county the authority to perform background criminal history and motor vehicle record checks on new employees. This is a new policy of the State Bureau of Investigations, approved by the State Bureau of Investigations, and was reviewed by Colonel Rodney Meads and Attorney Mullen.

The public hearing was set at the January 3, 2005 Board meeting and advertised in the Daily Advance.

County Manager Randell Woodruff stated the authority to drug and alcohol test employees is granted in the personnel policy.

Ordinance No. 2005-02-02 Proposed Amendment to Article 151 of the Camden County Code of Ordinances

Commissioner Andrews made a motion to go into public hearing to receive comments from the public regarding Ordinance No. 2005-02-02. The motion passed with Chairman Jeralds, Commissioners Jennings, Carolyn Riggs, Clayton Riggs, and Andrews voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

The Planning Board met on August 18, 2004 and voted 4-0 to recommend approval on proposed text amendment to Article 151.065 - Height Limitations and Article 151.243 – Improvement Guarantees.

The public hearing was set at the January 3, 2005 Board meeting, and advertised in the Daily Advance.

Planning Director Dan Porter stated Ordinance No. 2005-02-02 is a series of text amendments to Article 151 of the UDO that pertains to three (3) different items:

Article III. 151.065 Height Limitations eliminates the height restriction on wireless communication towers establishing as acceptable in Industrial 1 (I-1) and Industrial 2 (I-2) zones with a special use permit. Mr. Porter stated currently the UDO restricts towers to 300’ and cites several minor changes: the Board of Adjustment has been changed to Board of Commissioners in terms of approval, and any tower under 300’ requires a zoning permit in general use district is changed to a special use permit.

Article 151.244 Maintenance of Dedicated Areas Until Acceptance currently allows a variety of forms of credit to be provided to the county by the developer for the completion and maintenance of roads. Mr. Porter stated due to difficulty in collecting on letters of credit, this option is being eliminated.

Article 151.243 Improvement Guarantees pertains to the process of approval for subdivisions and the roads related to the subdivision by requiring the developer to obtain a 125% performance bond for the construction of roads within twelve (12) months of final plat approval. Mr. Porter suggested that the Board include in the text that no certificate of occupancy will be granted until the roads are paved.

Attorney Herbert Mullen added (1) Surety Performance Bond: The developer shall obtain a performance bond from a surety bonding company authorized to do business in the State of North Carolinaas approved by the Planning Department”.

Following discussion, Commissioner Jennings made a motion to close public hearing regarding Ordinance No. 2005-02-02. The motion passed with Chairman Jeralds, Commissioners Jennings, Carolyn Riggs, Clayton Riggs, and Andrews voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Public Hearing – CAMA Advanced Core Land Use Plan

Per the joint meeting with the Planning Board on December 16, 2004, Dale Holland gave a presentation and overview of the land use plan. Mr. Holland was to meet with the Planning again on January 19, 2005, however, due to weather conditions, was unable to attend the meeting.

At the February 7, 2005 Commissioners meeting, the Board set this matter for public hearing on February 21, 2005.

The public notice of a public hearing requires a thirty (30) day advertisement and was to be in the Daily Advance and Va Pilot on January 21 and February 10, 2005. However, Mr. Holland pulled the advertisements, and no public hearing can be held at this meeting.

Planning Director Dan Porter requested that this matter be laid over until the April 4, 2005 Commissioners meeting to allow for proper advertising of the public hearing.

Hearing no objections, Chairman Jeralds so ordered this public hearing be laid over until April 4, 2005 to allow for advertising of a public hearing notice.

EMS Contract and Services

County Manager Randell Woodruff stated that the Rescue Squad will be decreasing staff hours and is considering a rate increase. The county will not have to contribute any additional funds this fiscal year. Mr. Woodruff suggested taking no action until the EMS Board met again.

Commissioner Clayton Riggs stated that the Board should take no action until the EMS Board presents more detailed information.

Impact Fees

Following discussion, Commissioner Clayton Riggs made a motion to authorize the County Manager on behalf of the Board to request local legislation on imposing an impact fee. The motion passed with Chairman Jeralds, Commissioners Jennings, Carolyn Riggs, Clayton Riggs, and Andrews voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Ordinance No. 2005-02-01

AN ORDINANCE OF THE CAMDEN COUNTY BOARD OF COMMISSIONERS REGARDING
CRIMINAL HISTORY AND MOTOR VEHICLE RECORD CHECKS

In order to protect the citizens of Camden County and their properties, the provisions of this ordinance are established to provide for criminal history and motor vehicle record checks on all new employees of Camden County, North Carolina. Subject to the provisions of this ordinance, employment with Camden County shall be denied with respect to those persons convicted of certain crimes against a person, certain crimes against property where intent is an element, any drug or gambling related offense, or certain motor vehicle offenses.

The Sheriff, or designee, shall conduct an investigation of any final candidate for a part time or full time position with Camden County government. It shall be a precondition of employment that an applicant provide necessary personal identification including social security number and drivers license so that the Camden County Sheriff, or designee, may cause a thorough search to be made of local and state criminal records to determine whether the applicant has a history of criminal convictions for the offenses named above by use of the networks of the State Bureau of Investigation, Division of Criminal Information (DCI).

The Camden County Sheriff, or designee, shall provide the findings made by the use of the DCI network to the Camden County Human Resources Director, or designee, provided that all necessary agreements with the State Bureau of Investigation have been executed.

An evaluation of any offense for purposes of employment will take into account the name and the circumstances of the offense and the time of the offense as they relate to the essential job functions for the position applied.

No action to deny employment will be taken until the Sheriff’s Office confirms the identity of the applicant by finger prints through the State Bureau of Investigation or a certified true copy of the public record is obtained.

This ordinance shall become effective upon its adoption.

Consideration of Ordinance No. 2005-02-02 A Proposed Ordinance Amending the Camden County Code of Ordinances – Article 151

Hearing no objections, Chairman Jeralds laid this matter over until the March 7, 2005 Commissioners meeting to take into consideration comments made during the public hearing.

Consideration of Advanced Core CAMA Land Use Plan

Chairman Jeralds stated this matter has been laid over until the April 4, 2005 Commissioners meeting.

Re-Appointment to Adult Care Home Community Advisory Committee

Staff received a letter of request from Regional Ombudsman Debra Sheard to re-appoint Min DelGarbino to the Adult Care Home Community Advisory Committee.

Commissioner Carolyn Riggs made a motion to re-appoint Min DelGarbino for a term of three (3) years, expiring August 2007, retroactive from August 2004. Planning Department – Building Inspection Fees – Commercial Structures

Building Inspector Larry Payne requested approval of the following building inspection fees regarding Commercial Structures to accommodate the future commercial building in Camden County:

  PLUMBING: $5.00/fixture, trap or similar device
     
  MECHANICAL: $100.00 1st Unit
    $ 25.00 each additional unit
    $   5.00 Fire Damper/smoke damper
     
  ELECTRICAL: $  20.00 Transformer/Generator
    $   5.00 each free standing parking lot light/sign

***Conditional Certificate of Occupancy for grade only, 1st 30 days no charge, each additional 30 days @ $50.00, to a maximum of 120 days, at which time the fee goes to $100.00 per 30 day period.

Finance Office – North Carolina Department of Revenue Distribution Data Verification of Beer, Unfortified and Fortified Wine Excise Taxes

Annually the Chairman signs a form verifying that the information that the Department of Revenue has on file is correct or to make necessary changes.

The Finance Officer has reviewed and approved the form.

Commissioner Jennings made a motion to authorize the Chairman to sign the Distribution Verification Data Form from the Department of Revenue for the distribution of the excise taxes to the county. Sheriff’s Office – Monthly Report

Sheriff Tony Perry reviewed the Sheriff’s Office January 2005 Monthly Report and the report of the Safety Committee.

Commissioner Carolyn Riggs asked if there were any leads regarding the vehicle fires.

Sheriff Perry stated not at the present time but was confident that the fires would be solved.

Budget Calendar 2005-2006

County Manager Randell Woodruff reviewed the Budget Calendar 2005-2006.

Commissioner Clayton Riggs made a motion to adopt the Budget Calendar 2005-2006 with the correction of the Budget Work Session on June 7 at 7:00 p.m. The motion passed with Chairman Jeralds, Commissioners Jennings, Carolyn Riggs, Clayton Riggs, and Andrews voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Volunteer Form

Staff received a Volunteer Form from Ms. Shirley Mays for the Senior Center Advisory Board.

Commissioner Andrews made a motion to appoint Ms. Mays to the Senior Center Advisory Board with a term expiring February 15, 2008. USDA BMAP Report

Wildlife Specialist Garrett Unrein provided the County Manager with a report for 2004 regarding jobs completed: (12), jobs in progress: (4), county savings in 2004: ($37,400.00), number of beavers removed: (34), and number of dams removed: (19).

No action taken.

Education Foundation Fundraiser

Previously the Board has donated money to the Education Foundation so the Foundation would get full benefit of the donation, and each Board member who would like to attend the fundraiser has paid for their own tickets.

Chairman Jeralds stated last year the Board donated three hundred dollars ($300.00), and the Commissioners paid for their own tickets.

Commissioner Clayton Riggs made a motion to support the Education Foundation with a donation of three hundred dollars ($300.00). NCDOT Meeting Update

County Manager Randell Woodruff gave a report of the recent NCDOT meeting: the four laning of US 158 project schedule for FY2007, which starts at the Camden/Elizabeth City bridge to Belcross. NCDOT has begun to meet with property owner along the route to discuss acquisition of property; the widening project for NC343 from the High School to South Mills has been temporarily delayed; discussed the Board’s request for a stop light at Belcross and NCDOT would take under consideration; and, improvements of acceleration lanes are scheduled for the US17 entrance to the Landfill project.

Resolution No. 2005-02-06 A Resolution of the Camden County Board of Commissioner Authorizing the Filing of an Application for Approval of a Financing Agreement Authorized by North Carolina General Statute 160-20

County Manager Randell Woodruff stated that the Camden County Board of Education met in regular session on February 10, 2005, and approved the process to file application for Qualified Zone Academy Bond (QZAB) authority. The application would focus on renovation of the media center at Camden County High School, which is extremely outdated and in sever need of updating. The Board of Education is requesting the Commissioners support in this matter with Resolution No. 2005-02-06.

Commissioner Andrews made a motion to approve Resolution No. 2005-02-06. The motion passed with Chairman Jeralds, Commissioners Jennings, Carolyn Riggs, Clayton Riggs, and Andrews voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

A RESOLUTION OF THE CAMDEN COUNTY BOARD OF COMMISSIONERS
AUTHORIZING THE FILING OF AN APPPLICATION FOR APPROVAL OF A FINANCING AGREEMENT AUTHORIZED BY NCGS 160-20

WHEREAS, Camden County, North Carolina desires to undertake renovation of the Camden County High School Media Center to better serve the students of Camden County; and

WHEREAS, Camden County desires to finance renovation of the Media Center by the use of an installment contract authorized under North Carolina General Statute 160A, Article 3, Section 20; and

WHEREAS, the current Media Center is a converted auditorium, and is unsuited for research using present day technology and multimedia;

NOW, THEREFORE, BE IT RESOLVED that the County Manager is hereby authorized to act on behalf of Camden County in filing an application with the North Carolina Local Government Commission for approval of the Project and the proposed financing contract and other actions not inconsistent with this resolution.

South Camden Water and Sewer District Board of Directors

Chairman Jeralds recessed the Board of Commissioners meeting to convene the South Camden Water and Sewer District Board of Directors meeting.

The Board of Commissioners recessed at 8:53 p.m.

Upon adjournment of the South Camden Water and Sewer District Board of Directors meeting, Chairman Jeralds proceeded with the regular meeting of the Board of Commissioners.

The Board of Commissioners reconvened at 9:46 p.m.

Closed Session

Commissioner Jennings made a motion to go into closed session pursuant to G.S. 143-318.11(a)(3) for the purpose of consulting with the county attorney. The motion passed with Chairman Jeralds, Commissioners Jennings, Carolyn Riggs, Clayton Riggs, and Andrews voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

The Commissioners entered closed session at 9:46 p.m.

Commissioner Clayton Riggs made a motion to come out of closed session and back into regular session. The motion passed with Chairman Jeralds, Commissioners Jennings, Carolyn Riggs, Clayton Riggs, and Andrews voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

The Commissioners re-entered regular session at 10:21 p.m.

Chairman Jeralds called for any motions. Hearing no motions, Chairman Jeralds continued with the meeting.

Adjournment

Hearing no motions or further business, Commissioner Jennings made a motion to adjourn the meeting. The motion passed with Chairman Jeralds, Commissioners Jennings, Carolyn Riggs, Clayton Riggs, and Andrews voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

The meeting adjourned at 10:22 p.m.
