MINUTES

The regular meeting of the Camden County Board of Commissioners was held Monday, July 18, 2005 at 7:00 p.m. in the Camden County Courthouse, Courthouse Complex, Camden, NC. The following members were present:

Chairman Jeralds called the meeting to order. Commissioner Jennings gave the invocation and led the Pledge of Allegiance.

Public Comments

Chairman Jeralds called for any comments from the public.

Don Gordon, 154 Sharon Church Road, asked who is ultimately the final person responsible for answering for the appointed committees, most especially the Joyce Creek Drainage Commission. Mr. Gordon stated he would like a direct answer as to whom the final person to talk with that is responsible for actions of the Joyce Creek Commission.

Hearing no further comments from the public, Chairman Jeralds proceeded with the meeting.

Consideration of Minutes – June 20, 2005 Regular Meeting, and July 5, 2005 Regular Meeting

Commissioner Clayton Riggs made a motion to approve the minutes of the June 20, 2005 and July 5, 2005 regular meetings subject to correction of typographical and technical errors. The motion passed with Commissioners Jennings, Carolyn Riggs, Clayton Riggs, Andrews, and Chairman Jeralds voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Consideration of Agenda

County Manager Randell Woodruff asked that Item VIII. Old Business C. Eminent Domain, Item IX. New Business I.1. Board Appointment – Coastal Resource Advisory Committee, Item IX. New Business K. Eliminating 911 Fee, Item IX. New Business L. Budget Amendment 2004-05-BA051 and 2004-05-BA052, and Item IX. New Business M. Closure of Gumberry Road be added to the agenda.

Commissioner Andrews made a motion to approve the agenda as amended. The motion passed with Commissioners Jennings, Carolyn Riggs, Clayton Riggs, Andrews, and Chairman Jeralds voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Public Hearing – USDA Rural Development – Possible Commitment of Funds for Camden Intermediate School – Funding Package

Commissioner Clayton Riggs made a motion to go into public hearing to receive comments from the public regarding USDA Rural Development – Possible Commitment of Funds for Camden Intermediate School – Funding Package. The motion passed with Commissioners Jennings, Carolyn Riggs, Clayton Riggs, Andrews, and Chairman Jeralds voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Notice of the public hearing was given in the Daily Advance on July 5, 2005.

Chairman Jeralds called for any comments or questions from the public regarding the possible commitment of $10,000,000.00 for forty (40) years for the construction of the Camden Intermediate School adjacent to the Grandy Primary School.

Susan Christensen, USDA Rural Development Specialist, was present to answer any questions.

Public Hearing – Rezoning Application – William J. Davenport - UDO 2005-04-40 – Ordinance No. 2005-07-01 An Ordinance Amending the Camden County Zoning Map

Commissioner Clayton Riggs made a motion to go into public hearing to receive comments from the public regarding Rezoning Application – William J. Davenport - UDO 2005-04-40 – Ordinance No. 2005-07-01 An Ordinance Amending the Camden County Zoning Map. The motion passed with Commissioners Jennings, Carolyn Riggs, Clayton Riggs, Andrews, and Chairman Jeralds voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Planning Director Dan Porter stated a Rezoning Application (UDO 2005-04-40) was received from William J. Davenport to rezone property from Light Industrial (I-1) and Residential (R-3-2) (two (2) acre lots) to Residential (R-3-1) (one (1) acre lots) located on Ponderosa Drive and Heritage Drive, South Mills Township. The Planning Board met on June 15, 2005 and recommended denial with a 3-2 vote. The agent for the applicant is Hyman & Robey. Mr. Porter reviewed the Findings of Facts.

At the July 5, 2005 Commissioners meeting this matter was set for public hearing and advertised in the Daily Advance July 8, 2005 and July 15, 2005.

Chairman Jeralds called for comments or questions from the public.

Ed Hyman, Hyman & Robey, stated his client is asking for an extension of the current residential area which would buffer the current residential area from the abutting industrial area. Mr. Hyman stated any access problems would be addressed.

Greg Stewart, 134 Puddin Ridge Road, spoke in favor of Rezoning Application UDO 2005-04-40 – Ordinance No. 2005-07-01.

Bill Bland, 112 Deer Trail, spoke in favor of Rezoning Application – William J. Davenport - UDO 2005-04-40 – Ordinance No. 2005-07-01, and presented the Board with a petition from the citizens of Country Heritage subdivision in favor of the rezoning.

Joe Higgenbotham, 115 Deer Trail, spoke in favor of Rezoning Application – William J. Davenport - UDO 2005-04-40 – Ordinance No. 2005-07-01.

Dan Korzeniowski, 111 Deer Trail, spoke in favor of Rezoning Application – William J. Davenport - UDO 2005-04-40 – Ordinance No. 2005-07-01.

Permit Technician Dave Parks stated most of the land use permitted in that area requires a Special Use Permit. Staff determines if that use is in harmony with the particular area, and under the Special Use Permit, landscaping and buffering is required. Based on these conditions staff makes recommendations to the Planning Board for their consideration. Mr. Parks further stated that the County Land Use Plan identifies these parcels as Industrial Zoning. Staff has not had time to update ordinances to comply with the newly adopted Camden County Land Use Plan. Mr. Parks stated the county is in no position to address any type of residential rezoning based on the county’s current infrastructure, and once the infrastructure issues are resolved, then residential rezoning can be considered.

Public Hearing – Rezoning Application – Robert Harris – UDO 2005-05-05 – Ordinance No. 2005-07-02 – An Ordinance Amending the Camden County Zoning Map

Commissioner Clayton Riggs made a motion to go into public hearing to receive comments from the public regarding Rezoning Application – Robert Harris – UDO 2005-05-05 – Ordinance No. 2005-07-02 – An Ordinance Amending the Camden County Zoning Map. The motion passed with Commissioners Jennings, Carolyn Riggs, Clayton Riggs, Andrews, and Chairman Jeralds voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Planning Director Dan Porter stated the rezoning application from Robert Harris is to rezone property from Light Industrial (I-1) to Highway Commercial located at 111 Lambs Road, Courthouse Township. The area, adjacent to highway commercial, is currently in use as farm land. The request is not to rezone the entire parcel but the portion adjacent to Lamb’s Road. The Planning Board met on June 15, 2005 and recommended approval with a 6-0 vote. The rezoning is in conformance with the County Land Use and Thoroughfare Plan. The rezoning will have an impact on fire and law enforcement.

The public hearing was advertised in the Daily Advance on July 8, 2005 and July 15, 2005.

Commissioner Clayton Riggs made a motion to go into public hearing to receive comments from the public regarding Special Use Permit – Robert Harris Business – Harris Underground Utilities. Planning Director Dan Porter stated that along with the rezoning, and in order for Mr. Harris to conduct an existing business that is growing, a Special Use Permit is required. Mr. Porter stated a special use public hearing relates specifically to the conditions required by the county ordinances and the public hearing is for evidence related to the use and meeting of the conditions of the County Codes. Mr. Porter reviewed the staff recommended conditions. The Planning Board met on June 15, 2005 and recommended approval with a 6-0 vote and the public hearing was advertised in the Daily Advance on July 8, 2005 and July 15, 2005.

Public Hearing – Small Cities Community Development Block Grant (CDBG) – Urgent Needs Application

Commissioner Clayton Riggs made a motion to go into public hearing to receive comments regarding a Small Cities Community Development Block Grant (CDBG) – Urgent Needs Application. The motion passed with Commissioners Jennings, Carolyn Riggs, Clayton Riggs, Andrews, and Chairman Jeralds voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Chairman Jeralds stated that notice of this public hearing has been placed in a local newspaper 10 days prior (on July 6, 2005) to the Hearing. The purpose of this Public Hearing is to explain Camden County’s proposed CDBG application and obtain citizen input. No written comments were received prior to the opening of the Public Hearing.

The County is in the process of applying for a $600,000.00 urgent needs grant to complete the sewer project.

The Small Cities Community Development Block Grant Urgent Need (CDBG-UN)- application will seek a $600,000.00 CDBG-UN Grant to be used with a $3,000,000.00 Rural Center Unsewered Communities Grant, a $400,000.00 Rural Center Supplemental Grant, a $2,546,011.00 Clean Water Management Trust Fund Grant, and $1,238,133.00 in local funds.

The $7,802,144 project will construct sewer collection, transmission and treatment facilities that will serve the County’s three (3) schools whose sewage flow exceeds the capacity of their individual sewage treatment systems as well as residences, businesses and offices located in the Camden Village area.

The County is seeking Urgent Needs funds as:
(1) the degree that sewage flow from the schools to individual sewage treatment facilities has exceeded treatment capacity has accelerated during the past eighteen (18) months resulting in increased pump and haul to avoid a public health risk;
(2) the proposed project will permit each school to abandon the use of individual sewage treatment facilities alleviating existing conditions;
(3) Camden County/Camden County Schools do not have additional resources to contribute to the project; and
(4) Camden County has exhausted other financial resources to alleviate the urgent need having secured $5,946,001.00 in committed grants funding toward the project.

Skip Green, Grant Consultant, stated the Small Cities Community Development Block Grant is administered by the North Carolina Division of Community Assistance. The purpose of the program is to address health and safety conditions when there is a short fall of funds for infrastructure. Mr. Green further explained the grant process, and was available to answer any questions.

Chairman Jeralds called for any comments or questions from the public regarding a Small Cities Community Development Block Grant (CDBG) – Urgent Needs Application.

Perry Morrow, 150 Keeter Barn Road, stated he knew the legislature has not passed the North Carolina state budget, so there is a good opportunity that some of these grants will be cut from the budget.

Mr. Green explained the federal government provides CDBG grant funds to the state, the state then writes up the plans and within those plans, the state establishes different programs. The federal money is there but because the state is the actual administrator of the money, the individual commissions can not make grant offers until the budget is adopted.

Consideration of Ordinance No. 2005-06-02 - Rezoning Application UDO 2005-04-01 Quality Crab Co. Inc.

Comments were received from the public on June 6, 2005, and this matter was laid over for consideration until July 5, 2005.

Ordinance No. 2005-06-02 requires a full board majority vote. At the July 5, 2005 Commissioners meeting, Ordinance No. 2005-6-02 passed 4-0.

Commissioner Jennings made a motion to approve Ordinance No. 2005-06-02 with conditions recommended by the Planning Board. Article I:      Purpose

The purpose of this Ordinance is to amend the Zoning Map of Camden County, North Carolina, which was originally adopted by the County Commissioners on December 20, 1993, and subsequently amended.

Article II.      Amendment to Zoning Map

The Official Zoning Map of Camden County, North Carolina, which was adopted on December 20, 1993, and subsequently amended, is hereby amended as follows:

The properties currently shown in the Camden County Tax Assessor’s Office as PIN 03-8899-00-06-8949 and 03-8899-00-06-9946 are hereby re-zoned from Mixed Single Family Residential (R2)/Commercial Fishing Overlay District to Marine Commercial (MC).

Article III.      Penalty

  1. Violations of the provision of this Ordinance or failure to comply with any of its requirements, including violations of any conditions and safeguards established in connection with grants of variances or Special Use or Conditional Use Permits, shall constitute a misdemeanor, punishable by a fine of up to five-hundred ($500) dollars or a maximum thirty (30) days imprisonment as provided in G. S. 14-4.
  2. Any act constituting a violation of the provisions of this Ordinance or a failure to comply with any of its requirements, including violations of any conditions and safeguards established in connection with the grants of variances or Special Use or Conditional Use Permits, shall also subject the offender to a civil penalty of one-hundred ($100) dollars for each day the violation continues. If the offender fails to pay the penalty within ten (10) days after being cited for a violation, the penalty may be recovered by the county in a civil action in the nature of debt. A civil penalty may not be appealed to the Board of Adjustment if the offender was sent a final notice of violation in accordance with Section 2203 and did not take an appeal to the Board of Adjustment within the prescribed time.
  3. This Ordinance may also be enforced by any appropriate equitable action.
  4. Each day that any violation continues after notification by the administrator that such violation exists shall be considered a separate offense for purposes of the penalties and remedies specified in this section.
  5. Any one, all or any combination of the foregoing penalties and remedies may be used to enforce this Ordinance.

Article IV.      Severability

If any language in this Ordinance is found to be invalid by a court of competent jurisdiction or other entity having such legal authority, then only the specific language held to be invalid shall be affected and all other language shall be in full force and effect.

Article V.      Effective Date

This Ordinance is effective upon adoption.

Albemarle Economic Development Commission (AEDC) Bylaws

County Manager Randell Woodruff stated he met with a representative from the AEDC Board and spoke to the Chairman of the AEDC Board to discuss the Commissioners concerns regarding the AEDC Bylaws. Mr. Woodruff stated AEDC feels, based on the size of Camden’s contribution to the AEDC, that the AEDC would like to leave the Bylaws as is. No changes have been made.

Larry Johnson, 106 E. Robin Court, Chairman of the AEDC Bylaws committee was present to answer any questions.

Commissioner Andrews made a motion to approve the AEDC Bylaws as presented. The motion passed with Commissioners Carolyn Riggs, Clayton Riggs and Andrews voting aye; Commissioner Jennings and Chairman Jeralds voting no; no Commissioner not voting; and no Commissioner absent.

Eminent Domain

Commissioner Carolyn Riggs made a motion for staff to draft a Resolution to the General Assembly, for the Board’s review, to prohibit the exercise of eminent domain to public purposes by local governments. The motion passed with Commissioners Jennings, Carolyn Riggs, Clayton Riggs, Andrews, and Chairman Jeralds voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Consideration of – USDA Rural Development – Financing Package and Resolution No. 2005-07-03 – Authorization to Execute Necessary Forms from USDA Rural Development

Commissioner Jennings made a motion to approve the USDA Rural Development – Financing Package and Resolution No. 2005-07-03 and authorize to Chairman and Clerk to the Board to execute necessary forms as required by the USDA Rural Development to obtain the loan for the construction of the Camden Intermediate School, adjacent to the Grandy Primary School. Commissioner Clayton Riggs seconded the motion. The motion passed with Commissioners Jennings, Carolyn Riggs, Clayton Riggs, Andrews, and Chairman Jeralds voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

Chairman Jeralds recessed the Board of Commissioners meeting in order to execute the necessary forms from USDA Rural Development.

Article I: Purpose

The purpose of this Ordinance is to amend the Zoning Map of Camden County, North Carolina, which was originally adopted by the County Commissioners on December 20, 1993, and subsequently amended.

Article II. Amendment to Zoning Map

The Official Zoning Map of Camden County, North Carolina, which was adopted on December 20, 1993, and subsequently amended, is hereby amended as follows:

The portion of property that abuts Lambs road and runs 250 feet deep currently shown in the Camden County Tax Assessor’s Office as PIN 02-8935-02-66-4911 is hereby re-zoned from Light Industrial (I-1) to Highway Commercial (HC).

Article III. Penalty

  1. Violations of the provision of this Ordinance or failure to comply with any of its requirements, including violations of any conditions and safeguards established in connection with grants of variances or Special Use or Conditional Use Permits, shall constitute a misdemeanor, punishable by a fine of up to five-hundred ($500) dollars or a maximum thirty (30) days imprisonment as provided in G. S. 14-4.
  2. Any act constituting a violation of the provisions of this Ordinance or a failure to comply with any of its requirements, including violations of any conditions and safeguards established in connection with the grants of variances or Special Use or Conditional Use Permits, shall also subject the offender to a civil penalty of one-hundred ($100) dollars for each day the violation continues. If the offender fails to pay the penalty within ten (10) days after being cited for a violation, the penalty may be recovered by the county in a civil action in the nature of debt. A civil penalty may not be appealed to the Board of Adjustment if the offender was sent a final notice of violation in accordance with Section 2203 and did not take an appeal to the Board of Adjustment within the prescribed time.
  3. This Ordinance may also be enforced by any appropriate equitable action.
  4. Each day that any violation continues after notification by the administrator that such violation exists shall be considered a separate offense for purposes of the penalties and remedies specified in this section.
  5. Any one, all or any combination of the foregoing penalties and remedies may be used to enforce this Ordinance.

Commissioner Andrews questioned the status of Gizmos located in South Mills.

Chairman Jeralds questioned the expense for the Fire Departments regarding burning houses at the county’s request for condemned properties.

Dan Porter stated he would contact the Fire Chiefs and have them document their expenses associated with burning condemned properties. The county will pay for the costs and put a lien on the property for reimbursement.

Hearing no objections, Chairman Jeralds so ordered the County Manager and Planning Director to discuss this matter with the Fire Chiefs.

WHEREAS, the Board of County Commissioners is of the opinion that the above described roads should be added to the Secondary Road System, if the roads meet minimum standards and criteria established by the Division of Highways of the Department of Transportation for the addition of roads to the System.

Closure of Gumberry Road

Following discussion with Planning Director Dan Porter, and hearing no objections, Chairman Jeralds so ordered further information from staff regarding the closing of Gumberry Road, and directed this matter to be placed on August 1, 2005 agenda for review before the August 11th deadline to file a report NCDOT for consideration.

South Camden Water and Sewer District Board of Directors

Chairman Jeralds recessed the Board of Commissioners meeting and called the South Camden Water and Sewer District Board of Directors to order at 8:55 p.m.

Upon adjournment of the South Camden Water and Sewer District Board of Directors meeting by Member Carolyn Riggs at 8:58 p.m., Chairman Jeralds reconvened the regular Board of Commissioners meeting.

Closed Session

Commissioner Clayton Riggs made a motion to go into closed session pursuant to G.S. 143-318.11(a)(3) for the purpose of consultation with attorney. The motion passed with Commissioners Jennings, Carolyn Riggs, Clayton Riggs, Andrews, and Chairman Jeralds voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.

The Commissioners entered closed session at 8:59 p.m.

The Commissioners re-entered regular session at 9:27 p.m.

County Manager’s Report

County Manager Randell Woodruff reminded the Board of the joint meeting with the South Mills Fire Department on Thursday, August 4, 2005 at 7:00 p.m. and stated the repairs to the water line on NC 343 and Scotland Road will begin before long, and Permit Technician Dave Parks is currently notifying property owners.

Reports from Commissioners Serving on Other Boards

Commissioner Andrews reported on the EMS Board and the importance of house numbers for assistance in locating emergency calls.

Other Matters

Commissioner Andrews made a motion to send a letter to Terina Nobles in recognition of qualifying to compete at the 2005 National Championships in Gilletee, Wyoming. The motion passed with Commissioners Jennings, Carolyn Riggs, Clayton Riggs, Andrews, and Chairman Jeralds voting aye; no Commissioner voting no; no Commissioner absent; and no Commissioner not voting.
