Rules of Procedure for the Conduct of Public Hearings

  1. Commissioners shall refrain from any comments during a public hearing with the exception to ask specific questions of a speaker so as to clarify points made by the speaker.
  2. Each person who speaks during the public hearing must state his or her name and street address each time he or she speaks.
  3. No person may speak a second time until all persons in attendance have been given an opportunity to speak a first time. No person may speak more than twice during a public hearing.
  4. No person may speak in the second round of speakers unless the speaker made a comment during the first round.
  5. The Chairman may stop a speaker from continuing if that speaker is saying essentially the same thing that a previous speaker has said.
  6. That Chairman shall not allow any abusive language or threats to any member of the public, Commissioners, or staff. The Chairman shall immediately gavel down and silence any speaker who is abusive or threatening.
  7. Any member of the commission may raise a point of order with the Chairman if the Commissioner feels that the Chairman is not following one or more of these rules. If a member raises a point of order, then the Chairman shall temporarily immediately halt the public hearing and grant the Commissioner raising the point of order not more than two minutes to state his or her point. The Chairman shall then rule on the point made by the Commissioner before the public hearing is continued or any further action is taken by the board. If, immediately following the chairman’s ruling and before any further by the board, three Commissioners vote to overturn the Chairman on his ruling regarding the point, then the vote shall be binding for the balance of the public hearing.
  8. The County Commissioners will typically NOT act on any matter at the same meeting during which a Public Hearing is held on that matter. The principal reason for this is to allow sufficient time for reflection on comments made during the Public Hearing and for further study.
    1. In the case where no comments during a public Hearing and on which Commissioners feel that all of the Commissioners feel they have sufficient information, the Chairman - in his sole discretion - may bring the matter up for consideration elsewhere on the agenda for possible action during the same meeting when the Public Hearing is held. Placing the item on the agenda during the same meeting at which a Public Hearing on the matter was held shall require an affirmative vote of all Commissioners.
    2. In those cases where comments in opposition are entered into the record of the Public Hearing, the item may still be placed on the agenda during the same meeting at which a Public Hearing on the matter was held but shall require an affirmative vote of all Commissioners (not just those present and voting).
